Terms of Service

Last updated: 30 September 2026

Welcome to Dani Parker Artist.

These Terms of Service explain the terms that apply when you use this website or purchase artwork, prints, greetings cards or commissioned artwork from me.

By using this website or placing an order, you agree to these terms. Please read them carefully before making a purchase.

Nothing in these terms affects your statutory rights as a consumer under UK law.

1. About me

This website is operated by:

Dani Parker
Email: daniparkerartist@outlook.com
Website: www.daniparkerartist.com
If you have any questions about these terms or an order, please contact me using the details above.

2. Products and artwork

I sell original artwork, art prints, greetings cards and other art-related products through this website.

Every piece of original artwork is individually created and may contain natural variations in colour, texture, brushwork and finish.

Colours displayed on a computer, tablet or mobile screen may differ slightly from the actual artwork or printed product due to differences in screen settings and display technology.

Where appropriate, product photographs may also show artwork in a lifestyle setting or alongside other objects for scale. Unless specifically stated in the product description, these additional items are not included with your purchase.

I make every reasonable effort to ensure that product descriptions, measurements, photographs and prices are accurate. Minor variations that are inherent to handmade artwork do not constitute a fault.

3. Availability

Original paintings are unique pieces and are available on a first-come, first-served basis.

If an artwork becomes unavailable before your order can be processed, I will contact you and provide a full refund for any payment already made.

Where artwork is being exhibited elsewhere, it may remain available for purchase through this website unless otherwise stated. If an artwork sells through another venue before an online order is processed, I will contact you and refund your payment.

4. Prices, Discounts and Promotions

All prices displayed on this website are shown in GBP / £.

Prices, discounts and promotional offers may change from time to time. Any change in price will not affect an order that has already been accepted.

The price payable for an item will be the price displayed on the website at the time you place your order. The total price, including any applicable delivery charges, will be shown before you complete your purchase and will also be included in your order confirmation email.

Unless otherwise stated, delivery charges are not included in the product price and will be shown separately at checkout.

For international orders, additional customs duties, import taxes or other charges imposed by the destination country may apply. Unless otherwise stated, these charges are the responsibility of the customer.

Prices displayed on this website may differ from prices offered at exhibitions, physical retail locations, galleries or through third-party retailers or stockists.

From time to time, I may offer discounts, promotional codes or special offers. Individual promotions may be subject to additional terms and conditions, which will be provided alongside the relevant offer. If there is a conflict between the terms of a specific promotion and these Terms of Service, the terms of the promotion will apply to that promotion.

I reserve the right to correct pricing or other errors on the website. If an obvious pricing error affects an order you have placed, I will contact you before processing the order and give you the opportunity to confirm the order at the correct price or cancel it. If you choose to cancel, any payment already made will be refunded.

5. Payment and Customer Information

Payment must be made using one of the payment methods available at checkout.

When placing an order, you agree to provide information that is accurate, complete and up to date, including your name, billing information, delivery address and contact details.

If any information you provide changes after placing an order, please update it or contact me as soon as reasonably possible so that your order can be processed and delivered correctly.

You confirm that you are authorised to use the payment method provided when placing an order.

By submitting an order, you authorise the relevant payment provider to process the payment for the total amount shown at checkout, including any applicable delivery charges, taxes or other charges that are clearly stated before you complete your purchase.

Payments are processed securely through the payment provider available through this website. I do not have access to or store your full payment card details.

If a payment is declined, reversed or otherwise cannot be completed, I may be unable to accept or fulfil the order until valid payment has been received.

If you believe a payment has been made incorrectly or you have any questions regarding a payment, please contact me at daniparkerartist@outlook.com.

6. Payment

Payment must be made using the payment methods available at checkout.

Payment must be received before an order is dispatched unless otherwise agreed in writing.

I do not store your full payment card details. Payments are processed securely through the payment provider available through the website.

7. Delivery

I will provide delivery information, estimated delivery times and applicable delivery charges during the checkout process.

Delivery times are estimates and may vary due to circumstances outside my reasonable control, including courier delays, adverse weather or other disruptions.

You will become responsible for the goods once they have been delivered to you or to a person you have nominated to receive them.

If your order arrives damaged, please contact me as soon as reasonably possible and provide photographs of the artwork and packaging so that I can investigate the issue.

For further information about returns, refunds and damaged items, please see my Refund & Returns Policy.

8. International orders

I may offer delivery outside the UK where this is available at checkout.

International customers are responsible for complying with any import requirements applicable in their country.

Any customs duties, import taxes or other charges imposed by the destination country may be payable by the customer unless otherwise stated at checkout.

International delivery times may vary due to customs processing and other circumstances outside my control.

9. Returns and cancellations

Your statutory cancellation rights and my returns procedure are explained in my Refund & Returns Policy.

For most physical goods purchased online, UK consumers have a statutory right to cancel within 14 days of receiving their goods, subject to applicable exceptions.

This cancellation right does not generally apply to goods made to the consumer's specifications or clearly personalised, which may include commissioned artwork.

Nothing in these terms limits your statutory rights.

10. Commissioned artwork

I may accept commissions for original artwork subject to availability and agreement.

Before work begins, I will confirm the agreed requirements, which may include:

  • Subject or concept

  • Size

  • Materials

  • Colour palette

  • Reference photographs or other materials

  • Price

  • Estimated completion time

  • Delivery arrangements

Because commissioned artwork is created specifically for you, commissioned work is generally not eligible for cancellation simply because you change your mind once work has begun, where the statutory exception for personalised or made-to-specification goods applies.

I will make reasonable efforts to create the commissioned artwork in accordance with the agreed requirements.

Artistic interpretation is an inherent part of a handmade original artwork, so the finished piece may not be an exact reproduction of reference photographs or preliminary discussions.

If I am unable to complete an agreed commission, I will contact you to discuss the available options.

Further information about commissioned artwork and cancellation rights is provided in my Refund & Returns Policy.

11. Intellectual property and copyright

All artwork displayed on this website, including original paintings, photographs, illustrations, designs, written content, logos and other creative material, belongs to Dani Parker unless otherwise stated.

Purchasing an original painting, print or other physical artwork does not transfer copyright or other intellectual property rights to the purchaser.

I retain the copyright in my artwork and may reproduce an artwork in the form of prints, cards, promotional material, social media content, my website, exhibitions or other legitimate artistic or promotional purposes, unless a separate written agreement states otherwise.

You may not reproduce, scan, photograph for commercial reproduction, copy, modify, distribute or sell my artwork or designs without my prior written permission.

12. Commissioned artwork and copyright

Unless otherwise agreed in writing, commissioning or purchasing an original painting does not transfer copyright to the customer.

I retain copyright in the completed artwork and may use photographs of the finished artwork for my portfolio, website, exhibitions, social media and promotional purposes.

If you require exclusive rights or restrictions on the use of a commissioned artwork, these must be agreed in writing before the commission begins.

13. Website content

I make reasonable efforts to keep the information on this website accurate and up to date.

However, I do not guarantee that the website will always be available, uninterrupted or completely free from errors.

I reserve the right to update, change, suspend or withdraw parts of the website where reasonably necessary.

14. Website use

You agree not to use this website:

  • For any unlawful purpose.

  • To attempt to gain unauthorised access to the website or its systems.

  • To introduce viruses, malicious code or other harmful material.

  • To copy or reproduce website content or artwork without permission.

  • In a way that could damage, disable or interfere with the website.

15. Links to other websites

This website may contain links to third-party websites or services.

These links are provided for convenience. I am not responsible for the content, availability, security or privacy practices of third-party websites.

You should review the terms and privacy policies of any third-party website you visit.

16. Limitation of liability

Nothing in these terms excludes or limits liability where doing so would be unlawful.

This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

Subject to the above, I will not be responsible for losses that are not reasonably foreseeable or that arise from circumstances outside my reasonable control.

If you are purchasing as a consumer, nothing in these terms affects your statutory consumer rights.

17. Events outside my control

I will not be responsible for delays or failure to perform my obligations where this is caused by circumstances outside my reasonable control.

This may include events such as natural disasters, severe weather, strikes, transport disruption, power failures, internet or technology failures, or other events beyond my reasonable control.

Where such an event affects your order, I will make reasonable efforts to contact you and minimise any resulting delay.

18. Privacy

Your personal information will be handled in accordance with my Privacy Policy.

The Privacy Policy explains what information I collect, why I collect it, how it is used and your rights in relation to your personal information.

19. Changes to these terms

I may update these Terms of Service from time to time.

The version displayed on this website will include the date on which it was last updated.

Any changes will not affect an order that has already been accepted unless the change is required by law.

20. Governing law

These Terms of Service are governed by the laws of England and Wales.

If you are a consumer living elsewhere in the UK, you will retain any mandatory rights and protections that apply to you under the law of the part of the UK in which you live.

21.Prohibited Uses

You may use this website only for lawful purposes and in accordance with these Terms of Service.

You must not use this website or its content:

  • For any unlawful, fraudulent or unauthorised purpose.

  • To purchase products using false, misleading or fraudulent information.

  • To interfere with or attempt to gain unauthorised access to the website, its systems or accounts.

  • To introduce viruses, malware or other harmful or disruptive code.

  • To copy, reproduce, download, modify, distribute or commercially exploit my artwork, photographs, designs, written content, branding or other website material without my prior written permission, except where permitted by law.

  • To use images or artwork from this website to create products, merchandise, prints, digital products or other commercial materials without my permission.

  • To use automated systems, bots, scraping tools or other methods to systematically collect or reproduce content from this website without my prior written permission.

  • To impersonate another person or misrepresent your identity or affiliation with another person or organisation.

  • To interfere with the security, operation or functionality of the website.

  • To use the website in any way that could damage my reputation, business or intellectual property rights.

I reserve the right to refuse or cancel an order where I reasonably believe that the website is being used fraudulently, unlawfully or in breach of these Terms of Service.

Nothing in this section is intended to restrict any rights you have under applicable law.

You must not:

  • Attempt to bypass, disable, interfere with or circumvent any CAPTCHA, security measure, authentication process or other protective technology used on this website.

  • Use bots, scripts, crawlers, scraping tools or other automated means to access, collect, copy or monitor content from the website without my prior written permission.

  • Introduce or transmit viruses, malware, malicious code or other harmful material.

  • Interfere with or disrupt the normal operation, security or availability of the website.

  • Attempt to test, probe or scan the website or its security systems for vulnerabilities without my prior written permission.Termination

Termination:

You may stop using this website at any time.

I reserve the right to suspend or restrict access to the website, or to refuse or cancel an order, where I reasonably believe that you have breached these Terms of Service, used the website unlawfully or fraudulently, attempted to compromise the security of the website, or otherwise misused the website or its content.

Where an order has already been accepted and paid for, I will not cancel or terminate the order simply because access to the website is subsequently restricted, except where cancellation is permitted under these Terms, the applicable terms of the purchase, or by law.

Any provisions of these Terms that are intended to continue after you stop using the website will remain in effect. This includes provisions relating to intellectual property, copyright, liability, governing law and any outstanding payment obligations.

Termination or restriction of access does not affect any rights or obligations that arose before the termination or restriction took effect.

Nothing in this section affects your statutory rights as a consumer.

22. Limitation of Liability

Nothing in these Terms of Service excludes or limits any liability that cannot legally be excluded or limited under UK law.

This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or restricted.

I am not responsible for loss or damage caused by circumstances that are outside my reasonable control, including delays or failures caused by third-party delivery providers, internet or telecommunications services, payment providers, customs processing, or other external circumstances.

To the extent permitted by law, I will not be liable for any indirect or consequential loss that could not reasonably have been anticipated at the time the contract was formed.

Nothing in these Terms affects your statutory rights as a consumer or limits any remedies available to you under applicable UK consumer law.

Where you purchase products from me as a consumer, I remain responsible for ensuring that those products meet the requirements of applicable consumer legislation, including being of satisfactory quality, fit for purpose and as described.

Nothing in this section prevents you from exercising any legal rights or remedies available to you.

23.Severability

If any provision of these Terms of Service is found to be unlawful, invalid or unenforceable, that provision will be treated as being removed or limited to the extent necessary.

The remaining provisions of these Terms will continue to apply in full.

Where possible, any invalid or unenforceable provision will be replaced with a valid provision that most closely reflects the original intention of the provision, while complying with applicable law.

Nothing in this section affects your statutory rights as a consumer.
